Terms and Conditions

Welcome to Akirah Group and Co. These Terms and Conditions govern your use of our website and services and products. By booking an appointment, making a payment, using our services, or purchasing any product from us you agree to comply with these terms. If you disagree with any part of the terms, you must discontinue using our services immediately.


  Booking Payments

  • All appointments require full payment at the time of booking. Deposits are non-refundable under any circumstances.
  • The remaining balance (if applicable) must be paid at least one week (7 days) prior to the event date. Failure to do so will result in the following:
  • 6 days prior: Client will receive a payment reminder and a warning of potential cancellation.
  • 5 days prior: A second reminder will be sent.
  • 4 days prior: If payment is not received and the client does not respond, the booking will be automatically canceled without a refund, and the outstanding balance will be sent to collections.

Withdrawal and Cancellation of Services

We reserve the right to withdraw or cancel any services at our discretion under the following circumstances:

  • Violation of Terms: If a client breaches our Terms and Conditions.
  • Unforeseen Circumstances: If circumstances beyond our control prevent us from fulfilling the service (e.g., natural disasters, extreme weather, global pandemics, illness, or death).
  • Non-Payment: If payments are not received within the agreed-upon time frame.


In the event of a cancellation, we will notify the client promptly and provide an explanation. However, clients remain responsible for any services rendered prior to cancellation.

  • Cancellations must be made at least 30 days before the event to avoid further charges.
  • 30-15 days prior: A credit will be issued for future services.
  • 14 days or less: The full balance remains due, and no refunds or credits will be issued.
  • If the event is canceled or rescheduled by the client for any reason, we are not responsible for accommodating the new date. If we cannot do so without undue hardship, no refund will be provided.



  Financial Transactions

All financial transactions made through our website or services are subject to Canadian federal laws and Ontario provincial laws governing online transactions, including but not limited to the Personal Information Protection and Electronic Documents Act (PIPEDA) and the Ontario Consumer Protection Act.

  • Payments for services must be made in full prior to commencement unless otherwise specified.
  • We reserve the right to refuse or cancel any order or transaction for reasons including, but not limited to, fraud, unauthorized transactions, or errors in processing.



 Liability and Errors

We make every effort to ensure that the information on our website is accurate and up to date. However, we do not guarantee the accuracy, completeness, or reliability of any content provided. We will not be held liable for any errors, omissions, or inaccuracies.

Additionally, while we aim to provide continuous service, we are not liable for any downtime, outages, or technical difficulties related to the website or our services, in accordance with applicable Ontario and Canadian laws regarding service disruptions.

 

 Copyright and Intellectual Property

  • All content on our website, including but not limited to text, graphics, images, logos, and software, is protected by Canadian copyright and other intellectual property laws.
  • You may not copy, reproduce, modify, distribute, or use any of our content for commercial purposes without prior written consent from Akirah Group and Co.
  • Any content you submit to our website or services (e.g., reviews, feedback, images) grants us a non-exclusive, royalty-free, and worldwide license to use, display, and distribute such content for promotional purposes.


 User Behavior and Prohibited Activities

Users must adhere to the following rules and guidelines when engaging with our website or services:

  • Unlawful Behavior: Any activities that violate local, provincial (Ontario), or federal laws are prohibited, including violations of the Criminal Code of Canada and Ontario's Anti-Racism Act.
  • Hate Speech and Harassment: We do not tolerate hate speech, discriminatory remarks, bullying, or any form of harassment, as defined under Canadian law, including the Ontario Human Rights Code.
  • Spam and Promotions: Unauthorized use of our platform for spam, unsolicited promotions, or advertising is strictly prohibited under the Canadian Anti-Spam Legislation (CASL).

We reserve the right to suspend or terminate the accounts of users engaging in any of these behaviors.

 

 Account Suspension and Termination

We may suspend or disable your account if you fail to comply with these Terms and Conditions, engage in unlawful activity, or otherwise violate the rules outlined herein. We also reserve the right to terminate accounts for any reason, at our discretion, without prior notice.


 Miscellaneous

  • Amendments: We reserve the right to update, modify, or change these Terms and Conditions at any time. Any changes will be posted on our website, and your continued use of our services constitutes acceptance of those changes.
  • Governing Law: These Terms and Conditions are governed by the laws of Ontario and the federal laws of Canada. Any disputes will be resolved in accordance with the applicable jurisdiction in Ontario, Canada.
  • Severability: If any provision of these Terms and Conditions is found to be invalid or unenforceable under Ontario or Canadian law, the remaining provisions will remain in full effect.

By using our services, you agree to these Terms and Conditions.

Common items in a terms and conditions agreement allow you to:

  • Withdraw and cancel services, and make financial transactions.
  • Manage customer expectations, such as liability for information errors or website downtime.
  • Explain your copyright rules, such as attribution, adaptation, commercial or non-commercial use, etc.
  • Set rules for user behaviour, like forbidding unlawful behaviour, hate speech, bullying, promotions, spam, etc.
  • Disable user accounts.
  • Write down any other terms or conditions that protect you or your audience.

REFUND, RETURN & CANCELLATION POLICY

At Akirah Group & Co., we uphold the highest standards of craftsmanship, service, and professionalism. To ensure clarity, fairness, and full transparency, we have separated our policies for Products and Services below.

SECTION 1 — PRODUCT POLICY

(Gowns, Hijabs, Undercaps, Accessories, Couture Veils)

1.1 — MADE-TO-ORDER & PRE-SALE GOWNS

All Akirah gowns are produced on a made-to-order basis. This means:

  • All gown sales are final.
  • No refunds, returns, exchanges, or cancellations are permitted once production begins.
  • Production begins immediately after full payment OR after the 60% deposit is received.


Production Timelines

  • Standard Production: 3–5 months
  • Rush Production: 2–4 months (must be approved and the rush fee added at checkout)
  • Orders requiring rush production without the rush fee paid will receive an invoice that must be settled before shipping.


Toronto Fitting Requirement (60% Deposit Orders)

If you choose the 60% deposit + fitting model, you must attend the fitting in Toronto once the gown arrives.
The remaining balance must be paid before the gown is released.


Forfeited Gowns

Gowns not collected within 2 weeks of arrival become off-the-rack inventory, may be discounted, and are non-refundable under any circumstance.
Any deposits paid are forfeited.


1.2 — HIJABS, UNDERCAPS & ACCESSORIES

All hijabs, undercaps, and accessories are final sale unless the item is:

  • defective
  • incorrect
  • damaged upon arrival

To qualify for a replacement:

  • The item must be unworn, unused, unwashed, and in its original packaging.
  • Photos of the defect must be provided within 48 hours of delivery.

No returns will be accepted due to:

  • change of mind
  • personal preference
  • color perception differences
  • sizing concerns
  • wear and tear after use


1.3 — DEFECTIVE OR INCORRECT PRODUCT

If you receive an incorrect or defective item:

  1. Email info@akirahgroupandco.com within 48 hours
  2. Provide:
    • order number
    • photos of the defect/issue
    • unboxing video if available

If approved, we will issue:

  • a replacement (if possible)
  • or a store credit

Refunds are only offered if a replacement is unavailable.

SECTION 2 — SERVICE POLICY

(Bridal Styling, Hijab Styling, Consultations, Event Bookings)

2.1 — BOOKINGS, DEPOSITS & PAYMENTS

  • All deposits are 100% non-refundable.
  • The date you select + deposit paid reserves your event date.
  • All events must be booked minimum 2 weeks in advance.
  • Remaining balances must be paid 7 days before the event.

If the balance is not paid:

  • 6 days before: Payment reminder sent
  • 5 days before: Second reminder
  • 4 days before: Final warning
  • Unpaid by 4 days before event:
    • appointment is automatically cancelled
    • no refund issued
    • client may be sent to collections for unpaid amounts


2.2 — REQUIRED PRODUCT PURCHASE

All styling clients must purchase an Akirah-branded hijab for their appointment.
This ensures:

  • color consistency
  • fabric compatibility
  • professional finish

Hijabs are final sale as outlined in the Product Policy.


2.3 — CONSULTATIONS

Each service/package includes a defined number of consultations.
If additional consultations are requested, they are billed at:

  • $65/hour prepaid before booking


2.4 — SERVICE ADD-ONS & EXTENDED HOURS

Any additional materials or specialty accessories:

  • will be quoted separately
  • require written client approval before purchase

Extended service hours:

  • billed at $65/hour
  • require client approval before continuation

If the client declines extended time:

  • the consultant’s time up to that point will still be billed


2.5 — CANCELLATION & RESCHEDULING (SERVICES)

Cancellations

  • 30+ days before event: No refunds, but a service credit may be issued
  • 15–30 days before event: No refund; service credit issued
  • Within 14 days: No refund, no credit


Rescheduling

You may request a new date, but Akirah Group & Co. is not obligated to accommodate the new date.

If your new event date conflicts with our schedule:

  • No refund is issued
  • No credit is issued


SECTION 3 — LIABILITY & SAFETY

We are not responsible for:

  • scalp, skin, head, or hair sensitivities
  • alopecia
  • migraines triggered by styling
  • allergic reactions
  • texture incompatibilities
  • irritation caused by client-provided products

Clients must notify us before the appointment of any allergies or sensitivities.


SECTION 4 — CODE OF CONDUCT

A respectful, safe environment is mandatory.

Akirah Group & Co. upholds a zero-tolerance policy for:

  • harassment
  • discrimination
  • threats
  • verbal abuse
  • inappropriate conduct


Penalty Fees (Per Incident)

  • Slurs (racial, gender, cultural, sexuality): $200 per word
  • Body shaming: $200 per word
  • Cursing: $45 per word
  • Threats to injure: $500 per threat
  • Threats to murder: $2,000 per threat
  • Threats of sexual assault: $9,000 per threat

Video surveillance will verify incidents.
Clients with concerns should contact customer support for resolution.


SECTION 5 — REFUND PROCESSING

Approved refunds (only for defective items or unfulfillable replacements):

  • processed within 14 business days
  • returned to the original payment method

Refunds do not cover:

  • shipping fees
  • rush fees
  • production costs incurred prior to cancellation
  • consultation fees
  • labor fees
  • extended service hours
